Blue Juice (Carl Prechezer, 1995) is set in Cornwall in the South West of England, and though it follows a group of surfers, the characters and the action are not located in an exclusive insider culture, as Karen Lury (2000: 101) has suggested. Rather, that subculture is open to outsiders who are capable of recognising its value, and is located within the United Kingdom. The narrative follows local hero, JC, who is about travel around the world with his girlfriend Chloe, but finds his life disrupted by the arrival of his childhood friends from London. The Londoners abuse and resist the regional culture of the South West, but are eventually won round and, along with JC, find their lives changed by their experience of the region. The focus of the film is on the characters, and it is through looking at their development that I argue that Blue Juice makes a case for the protection of regional subcultures in the UK.
In Blue Juice, the South West is represented as an organic and natural place, with an emphasis on the landscape, the coast, and the sea. The film divides sequences through shots of the waves breaking or of the landscape and at numerous points the surfers comment on the build of the swell out to sea, so that the environment is a constant presence in the film. The local community demonstrates an intimate awareness of the environment for example, JC is able to perfectly predict Terrys route along the coast; and the environment is also represented as being the guarantor of authenticity, as is evident in the sequence where JC and Chloe at the blowhole, which when they are lying. Though the film is set in the South West of England some of the surfing sequences were filmed in Lanzarote, and as a consequence of this there is a break in the continuity between the overcast climate of Cornwall and the bright sunshine of the wave sequences. This break in continuity has an impact on how we perceive the region: JCs description of the swell at the Boneyard shows him and his friends against the dark cliffs and grey skies of England, but as he looks out to sea the point of view shot associated with him shows the waves in bright sunshine giving the surf an aura of fantasy. The unreal nature of the sea is also evident in JCs nightmares of being dashed against the rocks. The South West is not simply an objective and material space it is also a state of mind. In contrast to Cornwall, London is an urban jumble that is marked by the static skyscrapers and congested roads that lack the energy and fantasy of the surf. The capital is first shown in a shot of the Thames, but unlike the open waters of Cornwall, the river is hemmed in on either side by the city, and represents the attitudes of Londoners to the South West, which are shown to be narrow-minded and stereotypical. Cornwall is represented as being far from London: the phones are unreliable and Terry is unable to call his fiancée, while the trains only run on certain days out of the tourist season. However, this does not mean that Cornwall is cut off from the rest of the nation, and though there is a vocal Cornish nationalist movement, the film clearly places the South West within the UK. At a number of points in the film the local radio station, Smuggler FM, breaks up the action with the strong Cornish accents of its presenters who point out that though the county is on the edge of the UK, far from being the last county in England it is, in fact, the first. The relationship between Cornwall and London is thus a matter of perspective. For example, the radio presenters counter the claim that the climate of the South West is by arguing that it is The attitude of those from the capital is that the South West is of peripheral significance to the nation, but the film shows that in experiencing the regional the Londoners are able to adjust their perspectives on life.
The South West has a transformative effect on those from outside the region, in this case JCs three friends from London Terry, Josh, and Dean. Terry is a neurotic pub landlord, who spends the first third of the film complaining about his sinuses and migraines. He is so reserved that in order to get him out of the capital it is necessary for Dean and Josh to drug and kidnap him. He is resistant to anything that might force him to experience something new telling his friends that, You cant make me enjoy myself. He is engaged but lacks anything in common with his fiancée, Sarah, beyond watching television and videos, and is content to lead his uninteresting life in London having never experienced any of the alternatives. Terrys new experiences come via his first attempt at surfing and Ecstasy, and he leaves behind his boring persona to act out his fantasies. At the rave he appears as the Silver Surfer, with his body sprayed in silver paint, and, having bumped into an actress who played Guinevere in a television show from his childhood, he arrives at a country hotel dressed as a knight and tries to carry her off. Finally he is reunited with Sarah but no longer wants to return to his life in London, and at the end of the film we see Terry and Sarah sitting on an Australian beach waiting for the sun to rise before a days surfing. Though the South West is distant from London, it is thus not the surfer community of Cornwall who are portrayed as being provincial but those from the capital who have lost contact with the rest of the country, and by going beyond the limits of London Terry is able to overcome his closed and neurotic personality to explore the world.
As a top London record producer, Josh is too to get involved in life in Cornwall. His refusal to participate is evident in his manner of dress, and his hats and sunglasses allow him to remain removed within the group, and his overriding concern for his image is evident when he states that he does not want to look like an agricultural worker. Somewhat incongruously for a film set in the South West, Blue Juice features a Northern Soul night at a local hall, and it is here that Josh is confronted over his appropriation of a Northern Soul record, Ossie Sands The Price of Pain, and his abuse of the song in remixing it as a dance track. In his defence he claims that he was only servicing the market, but the point is made that the London culture is parasitical in its relationship to the other regions, and that regional subcultures serve as the source for commercial exploitation in the capital. Earlier Josh has made a point of establishing his presence at the home of the Northern Soul scene, the Wigan Casino, in order to impress Junior, a female DJ, and he is happy to draw on the cultural cachet this gives him even if he does not respect the scene itself. It is later revealed that Junior is Ossie Sands daughter. At the Soul night he is able to rediscover the joys of the scene, and sheds his cool persona to dance awkwardly with the others. At the end of the film, Josh is shown producing a record for Ossie indicating his return to authenticity, but alongside him sits Junior who prompts him to do a remix because they gotta pay the bills. The film does not argue that contemporary culture is inherently inferior to older cultural forms, or that regional subcultures should be regarded as pure, untouchable, and closed to other cultural forms, but that the appropriation of a subculture by the mainstream without respect needs to be countered.
The quality of economic activity to the region is also a significant element of the film, and is manifested in Deans attempts to find a career for himself. The environment of the South West sustains the local community economic activity is related to the environment with the land is used for farming, and the sea for fishing and surfing; while London, lacking any natural resources, exists as a cultural parasite exploiting the regions. Dean is, in his own words, a professional fuck up, and in contrast to the supportive community of the surfers, the Londoners are constantly sniping at and trying to undermine others: he sells fake drugs to the locals while claming to live in the area, sells out Josh to a tabloid newspaper, and is prepared to sacrifice JC on the rocks of the Boneyard in order to secure a job for himself. Mike, the newspaper editor from London, tries to manipulate the surfing of the Boneyard for his own ends, adding to the damning view the film projects of London as exploiting the regions. Mike provokes a dramatic reaction from Shaper, who gives up twenty years of non-violence to punch him in the face. Though he adopts the style of a surfer and attempts to ingratiate himself into the subculture by using the slang of the surfers, Dean is disrespectful to others around him and when he goes surfing crashes through other surfers in the sea. Style has been identified as a key element of subcultures (Hebdige 1979), but in Blue Juice membership of a particular subculture requires more than the adoption of the surface elements of style it demands commitment and respect. Though he pretends to be a surfer, Dean learns this lesson the hard way when he knocks himself unconscious whilst trying to surf the deadly Boneyard. Terry, by contrast, does acquire the style of a surfer (or at least he gets a tan and grows a goatee), but only once he has made a conscious decision to broaden his experience. At the films end, Dean has discovered his place in the world and chooses to remain in the South West working as a surfboard maker apprenticed to Shaper. (This choice recalls Rentons decision in Trainspotting (Danny Boyle, 1996) to choose life, and Ewan McGregor plays both roles). As Deans example demonstrates, economic activity is related to the everyday life of the surfers and affords them the opportunity to work in the production of their leisure time.
This focus on economic activity that is appropriate to the lives of the surfers is also a feature Chloes determination to buy the local café that is the hangout for the surfers. If the metonymic image of banal regionalism is the flag hanging unnoticed on the public building, in Blue Juice this is literally the case as in one shot a flag depicting an ice cream with the word emblazoned upon it hangs limply on the local café. Chloe seeks to preserve the café from being taken over by an outsider and turned into a Captain Ahabs theme bar, and her efforts to buy the lease are a form of resistance to the homogenisation of culture that threatens to erode the distinctiveness of regional cultures. In order to raise the money to buy the lease, she organises a rave on a local beach, again emphasising the close relationship between the community and the landscape: the cliffs prove a natural amphitheatre and the beach functions as a dance floor. As JC has to surf the Boneyard in order to rescue Dean he is unable to get Chloe the money she needs to buy the café. To make up for this he purchases a broken down shack that he and the other surfers renovate, abandoning the old place because it no longer represents the authenticity of South West.
JC, the local hero who surfed the Boneyard, is approaching his thirtieth birthday has decided to travel round the world surfing and is trying to persuade his girlfriend Chloe to join him. His decision to move on is articulated by his fear that in settling down in one place he will end up like Terry boring, neurotic, and miserable. Though he has been in Cornwall for a number of years, JC is caught between his friends from London and his life in the South West, and tries to please everyone all the time but ends up pleasing no one, and this is derived from the fact that he has yet to resolve for himself which regional identity (London or South West) he should choose. His exasperation with his friends from London shows that JC has moved beyond their provincialism and exploitation of the regions, while his willingness to leave the South West indicates that he has not fully accepted his own place within the community. As a consequence of this he finds himself placeless, an outsider in both regions. This is represented spatially when Chloe kicks him out of their home, and he is forced to share with his friends in a run down caravan that is removed from the town. His failure to commit leaves him increasingly marginalised from the surfers (one even asks if he can date Chloe once JC has left), but does not reconcile him to his London friends who cause him nothing but trouble. Ironically it is Dean who resolves this conflict of identities for him: recalling the first time they came to Cornwall fresh out of school, Dean remembers that JC stood up on his first attempt at surfing and that he was a Unlike Dean, JCs regional identity is not a matter of choice; it is a matter of destiny: though he is a Londoner by birth he his decision to support Chloe and remain in the region reflects his own recognition that he has found his natural place in the world.
Ben Thompson argues that: For all its multiple happy-endings, Blue Juices final message is that the search for cultural validation and meaningful career development in post-industrial Britain is by no means an easy one (1995: 44). Though it may prove to be difficult, Blue Juices final message is that such cultural validation is possible: the ageing hippie surfer, Shaper, wonders whether he will be able to levitate if all things were in harmony, and at the close of the film he does indeed rise above the ground because the problems of the surfers and the Londoners are resolved by establishing a harmony between the region and the capital. As Lury writes, the representation of a particular community by the film is therefore designed to construct a somewhat idealised local culture as a place outwith, and literally distant from, the commercial taint and inauthenticity represented by London (2000: 101); but this idealised community is located within the nation and makes the claim for the importance of regional subcultures to the life of the nation. It is the distance of the community from London, the very fact that it is which gives the South West its uniqueness and establishes its relevance within the UK.

Today I know many people who can not bring themselves to use an outdoor washroom facility. If you cant use an outhouse how are you going to manage to go in the woods? Do you know enough to dig a hole and bury your waste? To make sure it is not where it may pose a risk to your water supply. Little things everyone knew a hundred years ago.

If You are a picky eater how are you going to get by when nature plays a big part in planning your meals instead of marketing executives at fast food chains. You have to learn to eat what is available. In the wilderness you will not be able to make your favourite thing for dinner. Most especially if you favorite thing to make for dinner is reservations. One major piece of advice, dont venture into the woods for a survival situation unless you have worked up to it. The most important kind of preparation you can make is mental preparation.

The advances in the development of outdoor clothing, equipment, emergency food and techniques have been growing rapidly in recent years. For those beginners interested in using the outdoors there is unlimited information on wilderness survival skills and equipment available. However, experience is the best teacher in any outdoor situation and your reaction in a wilderness survival situation depends on your education, training and practical experience. Always keep in mind that it can happen to you. Those who are mentally and physically prepared to survive are more likely to do so. To deal with an emergency situation one must be able to make decisions, improvise and remain calm. Running though possible scenarios in your mind or even better having drills or exercises to practice those may make the difference between life and death in a real setting.

Fear - For anyone faced with a wilderness emergency survival situation, fear is a normal reaction. Unless an emergency situation has been anticipated, fear is generally followed by panic then pain, cold, thirst, hunger, fatigue, boredom and loneliness. It is extremely important to calmly assess the situation and not allow these seven enemies of survival to interfere with your survival.

Pain - Pain may often be ignored in a panic situation. Remember to deal with injuries immediately before they become even more serious. Getting the best first aid training available to you is extremely important. Next would be seeing that all members of your group are as up to date with theirs as is practical. Finally carry the best first aid kit you can under the circumstances. The kit you can throw in a car and take to a permanent campsite is going to be far more extensive than the one you backpack into the mountains. Few think of ascending levels of first aid kits. My largest is at home and is made up of other kits inside it which can be taken instantly in the event of needing to move quickly. The first aid and survival kits you keep on hand should be updated at least four times a year. They need to be adjusted to keep up with seasonal variations in conditions and the area you are in.

Cold - Cold lowers the ability to think, numbing the body and reducing the will to survive. Never allow yourself to stop moving or to fall asleep unless adequately sheltered. This becomes many times more important in the event you are wet as heat is conducted away from your body extremely quickly in such situations.

Thirst - Dehydration is a common enemy in an emergency situation and must not be ignored. It can dull your mind, causing you to overlook important survival information.

Hunger - Hunger is dangerous but seldom deadly. It may reduce your ability to think logically and increase your susceptibility to the effects of cold, pain and fear.

Fatigue - Fatigue is unavoidable in any situation so it is best to keep in mind that it can and will lower your mental ability. Remember that in an emergency situation this is often the bodys way of escaping a difficult situation. Soldiers have a saying, never stand when you can sit, never sit when you can lie down and dont pass up an opportunity for sleep.

Boredom Loneliness - These enemies are quite often unanticipated and may lower the mind's ability to deal with the situation.

HOW TO:
Build a Fire

Building a fire is the most important task when dealing with survival in the wilderness. Be sure to build yours in a sandy or rocky area or near a supply of sand and water as to avoid forest fires. The most common mistakes made by those attempting to build a fire are: choosing poor tinder, failing to shield precious matches from the wind and smothering the flames with too large pieces of fuel. The four most important factors when starting a fire are spark - tinder - fuel - oxygen. In days gone by it was unthinkable to travel without tinder. Tinder being the easily lit fuel you use to start a small fire which you build into a larger one by adding fuel.

The most common ways to create spark are:

1. Waterproof, strike-anywhere matches are your best bet. Matches may be water-proofed by dipping them in nail polish. Store your matches in a waterproof container.

2. A cigarette lighter is also a good way to produce a spark, with or without fuel.
3. The flint and steel method is one of the oldest and most reliable methods in fire starting. Aim the sparks at a pile of dry tinder to produce a fire.

4. The electric spark produced from a battery will ignite a gasoline dampened rag.
5. Remove half of the powder from a bullet and pour it into the tinder. Next place a rag in the cartridge case of the gun and fire. The rag should ignite and then may be placed into the tinder.

6. Allow the suns rays to pass through a magnifying glass onto the tinder.

7. I personally like to take with me special matches prepared ahead of time. I use a whipping knot to wrap the match. Which should be of the strike anywhere type then dip it in paraffin wax? This in effect makes the match a candle providing you with much more time to start your fire.

Dry grass, paper or cloth lint, gasoline-soaked rags and dry bark are all forms of tinder. Place your tinder in a small pile resembling a tepee with the driest pieces at the bottom. Use a fire starter or strip of pitch if it is available. I carry some powdered magnesium in my survival kit. I also carry a small bar of it with a flint side. It will not burn in solid form but a single spark can ignite the powder. It burns at thousands of degrees so is useful in igniting even damp wood.
It is important to keep in mind that smaller pieces of kindling such as, twigs, bark, shavings and gasoline, are necessary when trying to ignite larger pieces of fuel. Gather fuel before attempting to start your fire. Obviously dry wood burns better and wet or pitchy wood will create more smoke. Dense, dry wood will burn slow and hot. A well ventilated fire will burn best.
Build a Shelter

A small shelter which is insulated from the bottom, protected from wind and snow and contains a fire is extremely important in wilderness survival. Before building your shelter be sure that the surrounding area provides the materials needed to build a good fire, a good water source and shelter from the wind.
Wilderness shelters may include:

1. Natural shelters such as caves and overhanging cliffs. When exploring a possible shelter tie a piece of string to the outer mouth of the cave to ensure you will be able to find your way out. Keep in mind that these caves may already be occupied. If you do use a cave for shelter, build your fire near its mouth to prevent animals from entering.

2. Enlarge the natural pit under a fallen tree and line it with bark or tree boughs.

3. Near a rocky coastal area, build a rock shelter in the shape of a U, covering the roof with driftwood and a tarp or even seaweed for protection.

4. A lean-to made with poles or fallen trees and a covering of plastic, boughs, thick grasses or bark is effective to shelter you from wind, rain and snow.

5. A wigwam may be constructed using three long poles. Tie the tops of the poles together and upright them in an appropriate spot. Cover the sides with a tarp, boughs, raingear or other suitable materials. Build a fire in the center of the wigwam, making a draft channel in the wall and a small hole in the top to allow smoke to escape.

6. If you find yourself in open terrain, a snow cave will provide good shelter. Find a drift and burrow a tunnel into the side for about 60 cm (24 in) then build your chamber. The entrance of the tunnel should lead to the lowest level of you chamber where the cooking and storage of equipment will be. A minimum of two ventilating holes are necessary, preferably one in the roof and one in the door.


CLOTHING AND EQUIPMENT
Clothing

Clothing must provide warmth and offer protection from the elements. Layers of light, natural fibers are best. Hats are a must, as they offer protection from both the heat and cold. Water proof outer layers are necessary.

Equipment

It scared me but then I realized it wouldn’t be that different.

That’s right girls, seven hours asleep next to each other is quality time for engineers. So, if you want to avoid falling into this trap don’t stay over very often. And I’m not saying engineers don’t like to cuddle after sex. Brian would initiate any spooning before I did. It’s just it comes to a point in your relationship that if you are around too much, he takes you for granted. So to protect yourself from becoming too attached or pushing him away by moving in half your closet, have separate interests that can keep you busy.

Avoid staying more than two nights in a row or you’ll wear out your welcome. Engineers don’t like neediness and clinginess. So, she volunteers to be imprinted to learn why everyone's not, well, happy. Topher is surprised, but he'll go for it.

This episode was originally called "Four Engagements" because four Actives are involved with certain tasks. First, we have November who's been reimprinted into Mellie. As she sees it, she just got back from a trip to Iowa where she visited Mom. She's got jet-lag, and is ready to go home. Never mind the Dollhouse doesn't look like LAX.
Paul's surprised Mellie/November is back, but she's more surprised he's pointing a gun at her. The stress of looking for the Dollhouse has taken a big toll on him. First, his door has five locks because he knows the Dollhouse spied on him with that special camera last week. He also learns the influence of the Dollhouse is deep, even including the FBI, and that it's located somewhere underground in L-A. The big problem is that he's also very deep in paranoia. This freaks her out, but he admits he's worried, too. He's so obsessed with the Dollhouse he can't even remember why he's looking for it. Well, we don't know either. However, Mellie/November figures she can keep him grounded...with a co-ed shower. They're about to get wet when she stops...and delivers a message from the Dollhouse. This time she explains she's a sleeper agent, and how she's been spying on him for months. He is also told that it's more important to find the true purpose of the Dollhouse than its location. However, he can't tell Mellie that he's aware of all this, or Adelle will call her about flowers in a vase. That would be bad news for Paul. Despite the fact he's got a million questions, like who's implanting the info into the Actives, he has to go along.

Sierra has been put into Sydney Bristow mode, as she looks for the spy. Before that, Topher and Dominic are concerned they can't find Adelle, and blame each other for the security glitch. Actually, one of them has something to hide.
Dominic figures the chip is NSA technology. Sierra has to get inside the NSA office, get some files what will uncover the traitor, and get out. She manages to eliminate a worker named Sato in a commuter train. She impersonate her in every way, even with contact lenses to fake her identity. She gets the file, which seems to be a sheet protector that's also a computer screen.

The third engagement involves Victor as Roger, the perfect companion to Miss Lonelyhearts. As his handler Serena escorts him out, they meet Boyd and Miss Domin-Echo with her whip. Victor/Roger drives to a woman's house with flowers in his hand. Later, he drives off in the woman's car to his real date, someone named Catherine,.....
...who is really Adelle DeWitt!! She's using an Active for sexy times? Somewhere in Hell, Hearn is yelling, "Hey, how is what you're doing to Victor different than what I did with Sierra?"
Well, they do look good together, and if loving him is wrong, etc. They share some quality time in the sheets, and a fencing match that's as intense as their lovemaking. We also learn he accidentally dropped her cell phone into the ocean. It seems that he's there to share her deepest needs and secrets with. She can always wipe them away. He talks about how she's helping people in her job, and she just says "Pathetic, self-deluding souls". But who does that really describe?
Adelle also gets philosophical about relationships. She says on your first date you try to hide your faults, then in a relationship you try to hide your disappointments,and in marraige you try to hide your sins. Since Adelle is married to her job, she may be right. Roger/Victor serves as the guy on the side that eases the pressures of life. Except he's an Active, and she's doing what she killed Hearn for. Pathetic, self-deluding soul.

ETA: I have heard from some people who disagree with what I think of Adelle's actions. Greanted, what Hearn did was sexually violate Sierra, an Active, in her neutral state. That's bad, and he got what was coming to him. Let's lok at Adelle turning Victor into her romantic idea, Roger. This, I think is just as bad because she's taking the Active and programming her for her needs. I thought the company handbook would warn supervisors not to do this sort of thing. Having the Actives do engagements for whatever the client wants is one thing, but executives like Adelle using Actives for free like they were the client just looks bad. At least eventually, she realized this was a bad idea.

The next morning, Adelle is crying. She finally found out about the security breach, and who is responsible.

Topher turns Echo into a spyhunter, who plans to question certain people. Dominic doesn't like the idea, but he'll go along. He likes the part where she starts her interrogation with Topher. We see that even though Topher thinks he's a genius, doing things his grad school professors never dreamed of, he is still worried what people think of him...which we already know.
Ivy complaints how Topher uses her as a gopher, while she says she can easily do his job.
Boyd gets to the point: "We're pimps and killers but in a philanthropic way." Echo trusts him with a statement like that.
Claire reveals she hasn't left the Dollhouse since the Alpha incident, and that worries Echo. She thinks it's not good to be devoted to your job and have nothing else. That's something Adelle and Paul have in common. It may also explain Claire's plan to make the Actives glitch-free. If Claire prefers to stay in the Dollhouse rather than step out to the outside world, so should the Actives.
It's a moot point, because Dominic says Sierra has proof Ivy is the spy. Echo, however, disagrees. By noticing body language, and a few other clues, she knows who's really the spy...

Well, you got me, he says...then tries to eliminate Echo, Topher and Ivy. He'll just tell Adelle Echo went off mission again. Echo overpowers him, even pushing him to the edge of a broken window. She tells him, "I'm not broken." In fact, she may be even better than that.
He's soon delivered to an angry Adelle DeWitt. He points out being in the Dollhouse is no gift, because it's hurt as many people as it has helped, especially Echo. He also thinks Adelle may bring herself down, especially if Rossum loses control of the Dollhouse. "The technology has to be reined in and controlled," she says. "By a clandestine organization with little government oversight?" she asks. (Isn't that like Wall Street?). Dominic thinks Adelle is just naive, but she's in charge. So, it's off to the Attic for him, where he'll be an Active in a box forever. She does this in a very professional manner, like a business transaction. Since he was with her for three years, she says it shouldn't surprise him.
Despite it all, he's still smiling. He predicts eventually Echo will erase them all, and they won't see it coming. He knows it's really a Dollhouse of Cards, or maybe one made of straw.

So, we end where we started, with Dominic about to be erased. He tries to shoot himself, and winds up hitting Adelle in the torso. It doesn't phase her one bit, and it's really a flesh wound. Jesse Ventura would be proud. All that's left is a lot of regrets, and Dominic's soul in a hard drive. Adelle tries to convince herself that losing Dominic is no big deal. It's what self-deluding souls do. Still, she can't understand why she didn't see this coming. At least she's decided to break it off with "Roger." She's also surprised how Echo found Dominic out, and discovers maybe she is evolving. Adelle's grateful, and just tells Topher to keep an eye on her. Maybe this is the start of what Dominic is predicting.
Finally, Boyd is promoted to Chief of Security, while a guy named Travis is Echo's new handler. He reads the script to bond with her, but it's clear her real bond is with Boyd.
That leaves one question: was Dominic the one inserting messages to Paul in Echo and November? Do they stop now that he's gone, or will someone else insert them? If it's the latter, the list of suspects gets a whole lot shorter.

Again, this episode was all about trust, and what happens when it's used or lost. Paul has to trust Mellie, or Echo, because it's his only way to be the Big Bad that blows the Dollhouse down, even though we still don't know why. Adelle thought she could trust Dominic, and now doubts herself even though she won't admit it publicly. Claire has lost trust in the outside world, and that affects her opinion about the Actives. All Echo knows is that she can trust Boyd. With his new job, though, what will happen if he has to choose between her and Adelle?

The show takes a break next week to allow Fox to start the final story arc of Prison Break with a two-hour "event". With the announcement the show will end one week early, some are worried the show won't get enough time to establish itself now that the story arcs are becoming more complex and compelling. We have also been assured we will meet Alpha.
Ratingswise, it rose to about 3.56 million, but dipped a bit in the 18-49 share with a 1.4. With DVR usage, it grew to a 2.0 in previous weeks. If Fox treated DVR showings with more respect, we'd be counting down to a second season right now. We can just hope the show itself is reason enough for a second season.

A trademark is a word, phrase, symbol or design, or a combination of those things, that identify and distinguish the source of one partys goods and services from those of another party. Trademarks are often a good source of income generation for organizations having well established brands. This is because the organization can license the use of their trademark for display on almost any item or piece of clothing you can imagine. A patent can be broadly defined as a temporary property right, often described as a, granted by a government to an applicant. Patents allow those who own or license them to have some significant market leverage. This leverage exists because a patent owner or licensee can control the use, manufacture, and sale of products covered by the patent. An example of a patent related to surfing is United States Patent No. 6,375,770 published as being assigned to ONeill, Inc. (Santa Cruz, CA). This patent relates to an apparatus and methods for the formation of adhesively bonded butt seams between foamed, fully cured, elastomeric, resiliently compressible and flexible sheets of material of the type used in wet suits. In very basic terms, if you want to make, use, or sell a device or method covered by the patent, you need Os permission, otherwise you may be the subject of an infringement action. While patents can be extremely valuable, they do not guarantee that the patent owner or licensee will financially benefit. A good patent is like a good board, it wont help you find those perfect waves, nor will it position itself, however, once youre there it lets you rip. Therefore, the critical thing you should keep in mind, whether you are an individual inventor or a decision maker for a multinational company, is that you need a patent strategy that dovetails into a solid business operations plan which includes marketing and licensing know how. While the patent systems around the world share many features, they are in no way identical. The U.S. patent system serves as a solid reference point from which to understand most of the other patent systems. The legal basis for granting patent rights is found in the text of the U.S. Constitution. Specifically Article 1, section 8, clause 8 reads, the Congress shall have the powerto promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discovery. This constitutional right to patent property entitles an inventor to certain rights to the invention for a limited time. Typically a patent grant has a life of 20 years from the filing date of a patent application. Once obtained, the patent grantee has the right to exclude others from making, using, offering for sale, selling, or importing the invention in the United States. In addition, U.S. patent law considers, with some qualifications, those who offer to sell, sells, or imports into the United States a component of a patented invention or a material or apparatus for use in practicing a patented process, liable as a contributory infringers. As you can see, if you obtain a patent you may have some serious power over what others can legally do.
A U.S. patent is obtained by first filing of an application. The patent application is a formal document that includes, in general, a description of how to make and use the invention, any necessary drawings or figures, and a set of formalized descriptive sentences called claims. Once filed, the disclosed invention is examined by the United States Patent and Trademark Office (USPTO) to determine whether it meets all the requirements found under U.S. patent law. During this prosecution phase the applicant has some limited ability to cure defects and/or amend portions of the application. The typical application, once filed, spends about 2 to 3 years at the USPTO being examined and prosecuted. The cost of filing a patent application through a patent attorney is dependent on the complexity of the invention, but is typically in the range of $3700 to $5600. The final cost of obtaining and maintaining a patent can add several thousand dollars more to the cost. However, the incentive for spending the money is that a strong patent directed toward a desirable product or method can command very large revenue streams as well as providing insulation from competitors. A seemingly natural law of patents is that the more valuable the invention is, the more likely it will be fought over, and the more important the drafting and prosecution of the application will become in determining who wins. In other words, a poorly written and prosecuted patent will likely not be worth much. If you are going to take the time, energy, and money to apply for a patent, it is a good idea to find a patent attorney or agent who is not only familiar with the field of your invention, but who will also give you quality work. A poor quality discount or over priced patent will do no one any good, especially the one paying for it.
To obtain a patent you must meet several stringent requirements. The first requirement is that the invention must be of eligible subject matter. Eligible categories in the U.S. are limited to processes, machines, manufactures, or compositions of matter which have a practical utility. Thus, U.S. patent law defines four invention categories that Congress deemed the appropriate subject matter of a patent. The last three categories define while the first category defines (i.e., inventions that consist of a series of steps or acts to be performed). The Supreme Court has stated that although patentable subject matter may be anything under the sun that is made by man there are some limits. The courts have held that such things as abstract ideas, laws of nature, and natural phenomena are outside the scope of patentable subject matter. This is based on the courts recognition that patentable subject matter must be a practical application or use of an idea, a law of nature or a natural phenomenon. Generally, this requirement is easily met.
Another requirement is that the invention must be novel. Novelty is concerned with whether the invention in the patent application pre-exists as it is claimed in the application. A patent will not be granted if the invention is not novel. U.S. law, however, is peculiar since the ridged bar to a patent will not arise if during a period of less than one year before filing application the invention was in public use or on sale in the United States or if the invention was disclosed in a patent or publication anywhere in the world. Unlike the U.S., most countries do not have a grace period provision. This means that any prior use, sale, or disclosure will bar the grant of a patent. For example, if you or your employees start selling your newly invented fin system at a local surf shop or tradeshow, you have one year to get a U.S. application filed. However, you have likely blown your ability to get foreign rights. The lesson here is that before you sell, offer to sell, talk about, write about, or otherwise disclose your invention you should file an application and/or talk to an IP attorney about your strategy for the invention.
An invention is also required to be . Obviousness is found if, although the invention has not been identically disclosed, the invention is obvious from the prior art to a person having ordinary skill in the art to which the subject matter pertains at the time the invention was made. Obvious inventions are not entitled to patent protection. Generally, a claimed invention is non-obviousness if there are no prior art references that, alone or in combination, teach or suggest the invention as a whole including each element of the claimed invention. Determination of obviousness is a very fact based analysis and covers a fairly complex area of patent law. The application must also the invention. This basically means that the inventors disclosure must enable one skilled in the art to make and use the claimed invention without undue experimentation. Factors to be considered in determining whether experimentation is include the breadth of the claims, the nature of the invention, the state of the prior art, the level of ordinary skill in the art, the level of predictability in the art, the amount of direction provided by the inventor, the presence or absence of working examples, and the quantity of experimentation needed to make or use the invention based on the content of the disclosure. The inventor must also describe the best way they know to practice the invention at the time they file the application.
The invention disclosure also must describe the claimed invention in sufficient detail such that one skilled in the art reading the description would recognize that the inventor had invented the claimed subject matter and had possession of the invention as claimed at the time the application was filed. Possession of the claimed invention is generally shown by describing the claimed invention with all of its limitations using words, structures, figures, diagrams, and formulas that fully set forth the claimed invention. Possession may also be shown in a variety of ways, for instance, description of an actual reduction to practice, or by showing that the invention was ready for patenting such as by the disclosure of drawings showing that the invention was complete, or by describing distinguishing identifying characteristics sufficient to show that the applicant was in possession of the claimed invention.
Patent claims are arguably the most important aspect of an application since they define the scope of protection afforded the invention. A regular utility patent application must have at least one claim, often having over a dozen. The claims define the borders of the property the inventor is staking out. A simple but enlightening comparison to real property instantly conveys the importance of patent claims. Imagine being given the opportunity to stake out a claim to a piece of real property. In thinking about what land you wanted, you would consider the terrain and general lay of the land as well as such things as access to the water. The control of fertile fields, water, beach access, and ports of entry would add immense value to your claimed real property. As with selecting real property, a great deal of care and forethought must be devoted to preparing and drafting the patent application. Inadequate description of how to make and use the invention may erode or destroy a portion of the potential property. Claims that are drafted without an eye toward business strategy may provide competitors an entry into a market that could have been prohibited to them.

In Respect to the remarks of President Barak Hussain Obama, The president of the United States of America. The Political Committee of a number of factions in the Iraqi Resistance, mainly the factions present in our front, respond with our point of view on the contents of his speech.

Over the last four months, as the battle of our people continues to free Iraq of all foreign occupation. We have been studying the movements on the ground as well as analyzing the intelligence in order to assess the next strategy that the US administration will take under the leadership of the new presidency.

We had formulated our own plan of action based on the above mentioned, but have chosen to give the new president enough time to gather his thoughts and have a suitable amount of reports briefings that would give him also a good picture of the daily developments on the ground.

President Obama, After listening to your speech on the 27th of February 2009, in which you declared your general and public understanding of the ongoing war against our people, and gave your military and the honorable people of the United States brief points on your intentions in our country, we felt the spirit of the speech that your predecessor President JFK gave on the 20th of January 1961, on his inaugural address. In this speech, he offered a turbulent world, a way out of tensions and paid with his own blood for challenging the interests of those in your consecutive governments who hold the true keys to power. Those who would do anything to preserve their interests, wealth, power to create wars conflict.

We mention this with great honesty in hope to spread awareness and remembrance that a new Caesar may be betrayed, by his own, if he chooses to follow a different path. We do believe, on the other hand, that the spirit of the speech was well chosen.

We have listened well to your economic plans for your country released before this speech as well, and as ambitious as it may seem, we believe that if intentions are genuine within your congress, a considerable number of what you seek will eventually be fulfilled, but in case of failure, the republicans will be looking for a scapegoat to relate all their failures to. In this case it would be your administration. This will guarantee them a fast comeback.

You have inherited a nation at war, a failed economy, and a desperate people who are bearing the full brunt of an economic crisis that was not of their making. As well as thousands of young men dead and handicapped.


We have inherited a foreign occupation, endless counts of innocent dead, injured, and handicapped, millions of refugees, in essence, Mr. President, the complete and planned disintegration of our nation and people.

We believe that the funds wasted in this war would have been more useful if it were spent on research to develop alternative energy, which no doubt would have reduced energy conflicts, cures for cancer, agricultural solutions to prevent worldwide poverty, advancements to develop Africa, where people still die of starvation and intentional neglect. Endless causes, all in need of immediate attention.


By the will of God almighty, the resilience of our men, and the patience of our humble people, we have so far managed to halt and render useless all imperialist agendas set for Iraq and the region in whole. Simply by choosing to resist occupation, a right guaranteed by God first and then by international conventions to all men. A right your countrys policies continue to disrespect and dishonor, in clear example to state sponsored Terrorism.

You have spoken to our people in part of your speech, and we thank you for these words, you have displayed a far better understanding our nation, than your predecessor, who preferred to dive deep into the oceans of illiteracy and ignorance. Despite the fact that you did not mention the Iraqi resistance in your speech, and chose to label us as terrorists along with those who arrived with your troops, we will set that aside for now, and mention a few facts for the record.

1- The people of Iraq whom you addressed, in all their sects colors and religions, refuse your occupation, and those who accept it, are those who benefit from it.
2- The Iraqis you addressed, as we truly hope, are not the ones who bathe in the riches of treason, behind your walls of the green zone, nor are they the likes of Ahmed Al Chalabi, whom your previous government conspired with and his likes from the dark alleys of 5 star hotels in the US and Europe prior to your occupation.
3- The Iraqi people you talked to, are those who never invited your occupation, and were trying their best to survive on what was possible, under the criminal sanctions that went on for 13 years only to be crowned with a foreign occupation, unmatched in criminal acts, in todays modern world.

President Obama, The suffering, that our people had to go through is beyond comprehension. And the endless crimes of your troops as well as that of neighboring countries, cannot simply be undone or dismissed, nor can they be brushed under the carpet. Your troops still occupy the land and kill the innocent, that is why we can only address you as the president of an occupying nation.

The Iraqi People are disappointed in your plan. They expect your troops to leave our country in full and not in part. Our people, seek a complete end of occupation and not the fulfillment of a strategic treaty that was rushed against the will of our people, in the last few days of your predecessor.

Our people, as well as the majority of people around the world, and in your country, want to see the last president be presented to an international war crime tribunal for all the crimes he has committed in the name of your country, only to benefit those who brought him to power in the first place.

We have never invited your occupation, nor have we asked your country to steal our countrys resources to benefit your corporations and to those neighboring states which historically fall under your influence. We have never asked you for your precious blood or ours, to us, all blood is precious even that of the your soldiers sent by your government to die not knowing what they were truly fighting for. This has to be addressed to the man who started this war, and is hiding now in Texas, while you try to undo his damage.

We the Iraqi People and their resistance demand the following:

1- The fulfillment of all the conditions presented to your government through the mediators you
Sent in 2006.
2- The hand over of all the traitors Collaborators in the green zone to the Iraqi people where
They will be dealt with as any nation would do with in cases of high treason.
3- The full just compensation for our people for the losses they have suffered.
4- The halting of all compensations paid to those who fall under your umbrella in the region from the resources of our people.
5- The return of all land stolen from our country.
6- The departure of all foreign corporations mainly in the sectors of energy, communication, infrastructure rebuilding, specifically those linked to Neocon interests. Our people are more than qualified to rebuild and operate our institutions.
7- The hand over of all mercenaries accused of killing innocent civilians mainly security contractors in Black Water and their CEO to be tried for murder.
8- All foreign advisors are to leave Iraq with your troops.


9- The dismantling of all militias equipped by your country and Iran together to shift the nature of battle towards the sectarian nature in order to allow your troops to concentrate on the major resistance activities in the central region of Iraq.
10- The halting of all support to the sectarian government elected in the orchestrated elections in the green zone.
11- The reduction of the influence of your Persian allies in Iraq which your previous government worked with in close conjunction and who continue to fund Al Qaeda on behalf of your intelligence agencys behalf.
12- The return to the old constitution of a unified Iraq. And the Upholding of new elections
Within 6 months of the resistance taking power of the nation, this will be supervised,
By must be conducted in the presence of a number of credible international monitors. Not the ones
Sponsored by the CIA.
13- Cities and provinces are to be handed over one by one starting with the four main cities and airports of Baghdad, Basra, then Mosul and Kirkuk in the same order. The rest will fall immediately in our hands. The borders will have other arrangements.

The list goes on, but the intention is to give you an idea of what we pledged our people to achieve. In return for our peoples demands, we will cease to attack all occupation forces withdrawing to the south and beyond the border post of Safwan.

Without these straightforward moves on your part, we regret to inform you that the resistance of the people of Iraq will continue until that last boot of US/British/Persian occupation is thrown across the borders of our country.

If you choose change as you claim, then you must have reached the conclusion that to continue dealing with the same people your predecessor appointed to fulfill his dirty work, will fail to deliver positive results for both our people. It is not the thieves of the green zone who brought the defeat of your military.

You must search further for the honest Iraqis and from the ranks of our people and not those of your collaborators to achieve a just solution. You can also recognize the right for the Iraqi people to resist and publicly ask for our advice and representation. The Iraqi people intend to be masters of their own house as they always have, and by following the plan you have declared, you have not yet fully understood Iraq well.

There are those who will claim, that a quick withdrawal from Iraq will cause civil war, and that is a possibility, but we would also like to clarify that the forces of the puppet government which has been equipped to defeat the resistance will not stand ground, nor will they block our efforts to liberate our cities one by one if we had to, and all the efforts of your collaborators to move to the north and south of the country and create their own federal states have been studied well for their weaknesses and will be crushed within a short period. This is a more realistic scenario. True there will be still the Persian occupation which will offer its militias support, but we know that the US cannot leave the oil rich south to be occupied by Iran, and they would rather see it fall in our hands instead. As it would be giving too much to a close yet not so trust worthy ally, and would deprive your military necessary funds that would support long-term military presence necessary in Iraq and throughout the region. Funds that some in your government think they can still rely on. Funds that your economy can no longer bear in the midst of the turmoil in the globalized economy of your nation, to control the world.

The Iraqi resistance understands well that the US could not continue to sell oil at a high price
of 120 USD/Barrel to cover the costs of its war, as this strengthens old adversaries. And it would be only a matter of time before this tactic backfires on the US foreign policy. But it also understands that the US cannot fund foreign occupation any more without depending on local resources and revenues to cover the expenses. This is the true cause of the change of as you named it President Obama.

With oil prices falling to their true realistic market values, the winter ending in the consuming economies, the oil prices should fall to 30 USD plus mark, which is also effecting the local economies of your allies in the region, as anything below 55 USD per barrel, is already becoming a burden on these


economies, which in turn can no longer assist to their full potential in funding and supporting the costs of US aggression in the Region.

The Declining of oil revenues, which we truly thank you for mentioning in your speech, will make it more difficult to fund your militarys operations in Iraq, and that is why the numbers of your troops is to be reduced. To match the income predicted from the oil projects sponsored by your corporations in the south and the oil theft operations run by your agent, Hamid Jaffar in the north of Iraq in collaboration with NGO oil of Norway, is what your strategists think is possible.

Yes President Obama, we do agree with you, that the US needs a smarter, more sustainable comprehensive approach, but rest assured, that what your predecessor has failed to achieve with all the military might at his disposal, we will make sure that you will fail to achieve the same goals through the soft hand of the Democratic party.

In fact, it is more logical and practical to follow the alternative energy programs that you have set wisely, to ensure the non reliance of your economy on oil as well as the utilization of advancements and added fruits of R D to employ the unemployed, and support a new and young market for the shift in energy dependence, and in turn end the monopolization of energy, practiced by the corporations that control it and control world political and social stability, than to merely dream of expecting the Iraqi People to hand you over their resources.

We on the other hand intend to nationalize and use our resources to build an alternative energy base our selves and offer our people a life of prosperity, stability, as well as supporting the energy transition of other nations that are oil dependant, a task we truly believe is noble and worthwhile.

The Iraqi Resistance will not accept any short term or long term energy contracts with the US until we ensure that the rights of our people are properly addressed. And within the parameters of relations based on mutual respect first and mutual interests second.

President Obama, It is time that people in Washington understand that there are no shared interest between an occupying tyrant and an oppressed victim of occupation.

Your government would have stayed forever in Iraq if the traitors who conspired with your consecutive administrations had their way in starving the Iraqi people into submission and force them to welcome your occupying troops with flowers as Chalabi promised you. But after three wars and over a decade of sanctions, there were enough honest men to defeat the worlds most powerful army play a major role in destroying the most imperialistic Globalized economy ever developed by expansionary capitalism.

These are the type of people you are speaking to Mr. Obama. And if you were not presented with this reality throughout the briefings that occurred, and understood the true scale of the economic disaster with all the social and geopolitical implications of your military defeat in Iraq, then please allow us to mention a few of the major achievements that the Iraqi Resistance have promised its people and the free people of the world and has delivered:

1- We promised to pin down your troops in Iraq and drain your economy until you admit defeat and withdraw your troops. And this we fulfilled.

2- We promised to halt the US plan for Middle East in full, and prevent the loss of other innocent lives in other neighboring countries, and that we fulfilled.

3- We embraced the war and continue the fight on behalf of all the oppressed world, which not only stood still and watched the massacre of our people and the illegal occupation of our nation, but many of its leaders participated and continue in harming our people inside and outside Iraq and assist in the theft of our resources. This, apart from the support of honest people all around the world,

4- including citizens of your country, who marched day and night to support the cause of Iraqs right to resist, marches that defied the weather, and weathered criminal defiance and ignorance of world politicians. Marches that we will ever be indebt to, and in gratitude in appreciation for. May god bless those people wherever they are. And this we fulfilled and continue to do so.

5- We have understood the nature of international balances of power and most importantly predicted the primitive mind of the occupation and played a major role in forcing the US to increase oil prices in clear desperation for cash. And use that to allow other powers to recover. And the numbers never lied, this we also fulfilled.

6- The Iraqi People wrote a new chapter in Urban warfare, and invented the art of remote combat, and in turn gave the world lessons and set a new standard in how to defeat the worlds most powerful army. In this, the most dangerous achievement that threatens US global influence is that all the oppressed people who suffer from negative US influence, can use this experience to free themselves as well. This also has been delivered.

7- The Resistance has already drafted its 2, 5 and 10 year plan to engage Iraq in rebuilding programs that will set a new standard for development in the Region and restore Iraq to its rightfully earned place in world politics and positive human development. This while maintaining Iraqs isolation from harmful neighboring countries at the same time, these plans was prepared and drafted in the early months of 2007 and are ready to implement once we see the end of your occupation.

8- The resistance created a new battle field and utilized every tool available to break free of the corporate media and tell, inform, and educate the world of the true nature of the struggle, and present every curious man and woman daily reports and videos of your militarys defeat and in every language possible. People from all over the world, chose out of their own free will and time, people of different religions and backgrounds chose to be soldiers of the cyber wars and translated all what we had to tell, asking nothing in return but the truth. The true casualties of your war are yet to be declared. (We refer to the green card soldiers)

9- The resistance has sparked not only the collapse of the US economy, but also caused the domino effect and the destruction of your fine tuned and delicate Globalized economy, and forced the return to national economic protection, and the rights of local and regional economies to grow and ensure a decent life and practice their right to develop as well. All your efforts to restore the globalized economy will deliver nothing of value, and puppet governments that maintain your oversight of world resources will eventually fall, one after the other, as their faults will be more evident to their average citizens, and that is why you are now receiving daily reports, from the CIA about the world economy.

ALL THE ABOVE, AND YOU STILL CHOOSE TO IGNORE THE RESISTANCE OF THE IRAQI PEOPLE AND THE RESISTANCE OF THE GLOBAL ALLIANCE OF THE FREE, WHICH WE INTENT TO PROPOSE TO THE WORLD AS THE NEXT STAGE OF FREEING THE PLANET FROM YOUR DOMINENCE WHEN THE TIME IS RIGHT.

ALL THIS SAID, AND THE GLOBAL MEDIA WHICH YOU STILL MAINTAIN CONTROL OVER STILL LABELS FREE PEOPLE AS TERRORISTS AND EQUALS THE RESISTANCE OF OCCUPATION WITH CRIMINAL ACTS OF STRIKING CIVILIANS IN BUILDING AND TERRORISING THE LIVES OF THE INNOCENT.

TRULY IRONIC !! Nevertheless represents the true state of shock you policy makers have reached. But all can be reversed if you truly believe in Change Mr. President.

The resistance along with the votes of the peace loving people in your country and choice of the world
Who brought you to power, are more than capable to pull you down and defeat your new strategy, if you choose to lie to them and follow the plans of your predecessor.


You must understand that the time when your foreign policy bullied and bribed people into submission is over and for a considerable time. And your politicians and strategists have to understand that to be accepted as a superpower you must first learn to speak to the world with modesty and respect that others in this planet, also have the right to provide for their families a decent life, the right to food and water, the right to education and knowledge, the right to industry and employment, and free from your corporate despotism.

We in the Iraqi resistance, renew our pledge to our people and to our brothers and sisters in the global family, to continue the fight and struggle to free Iraq and give our allies the chance to follow suite.

While you were preparing your new strategy in leaving the streets and highways of Iraq to your collaborators, and hiding your troops behind the walls of the castles and green zones you have prepared for your minimized long term presence, we have been preparing to address your new tactics and will deal with them in the proper manner.

Remember, that hiding behind and holding castles is no longer sustainable in modern warfare!

Your finest fighting force as you name it, is up against the most witty, resilient innovative self-propelled resistance honorable humanity has ever presented. Rest assured that we are not impressed with your plan and will follow your movements on the ground and cross examine them to your declared intentions and daily economic reports. There is no such thing as friendly occupation, and we advise you to revise your plans to vacate Iraq at a time suitable for our people and not suitable for your agents in the green zone.

Undoubtedly, many parents will be unwilling to ask for help if doing so resigns one child to a lifetime of inclusion on an internet-based registry, with all the restrictions on schooling, employment, and residency it entails, as well as potential threats to that childs safety. As a result, in many instances, neither offender nor victim will receive the treatment they need.

The risk of mandatory, lifetime inclusion on a public registry will also mean that children facing charges for sex offenses will be less likely to plead guilty and more likely to go to trial, thus exposing the victim and others to the trauma of testifying and to other intrusive aspects of the criminal justice system. And childrens defense counsel will certainly work to get sex offense charges reduced to non-sex offense charges, such as assault, in order to avoid the severe consequences of lifetime inclusion on the public registry. But a child adjudicated delinquent for assault is unlikely to receive sex offender treatment, which results in tremendous lost opportunities for treatment and the prevention of further harm.

The list of offenses to be included on the public registry may seem to target only the worst of the worst of juvenile sex offenders. But in Ohio, the offenses recognized as equating to the federal definition of aggravated sexual abuserape, sexual battery, and gross sexual impositioninclude a wide range of behaviors.

Several years ago, my office represented a 16-year-old boy. On the school bus, Brian sat next to a 15-year-old girl whom he had dated previously. He touched his former girlfriends breasts through her clothes, and attempted, unsuccessfully, to put his hand down her pants. The girl testified at trial that Brian had put his hand down her pants bout to the knuckle line. Brian was adjudicated delinquent for attempted rape and gross sexual imposition.

In another example of a client my office represented, a 14-year-old boy, and several other children had been at a friends house without parental supervision. Zach and some of the boys had stolen bottles of alcohol, and the girls had set up a tent in the yard. At some point in the evening, Zach and a 10-year-old girl, who had become boyfriend and girlfriend earlier that day, were lying on their sides next to each other in the tent. He put his arm over the girls midsection and touched her below her beltline but did not put his hand in between her legs. Zach was adjudicated delinquent for gross sexual imposition on a victim under the age of 13.

My office also represented whose case highlights many of the problems typically found in juvenile courts. Michael was removed from his mothers custody at the age of 11, after being physically abused, and over the next several years was placed in seven different foster homes. He is very low-functioning and has been diagnosed with attention deficit disorder, extreme mood swings, and reactive attachment disorder. Despite this, Michael was adjudicated delinquent for gross sexual imposition without being represented by counsel. Michael certainly should have been evaluated for his competency to face the GSI complaint, but he had no attorney to raise the issue, and Ohio lacks a competency statute for juveniles.

The Adam Walsh Act purports to protect society from dangerous sexual predators, like the adult pedophiles, unknown to their victims, who kidnapped, sexually assaulted, and murdered Adam Walsh, Jacob Wetterling, Jessica Lunsford, and the other children for whom the legislation is named. But, with the overly broad requirements of the Adam Walsh Act and Ohios SB 10, Ohioans instead find themselves from children like Brian, Zach, and Michael.

The year that Ohio implemented the Adam Walsh Act also marked the 40th anniversary of In re Gault, the landmark U.S. Supreme Court decision that granted many basic due process rights to children in juvenile court, including the right to advance notice of the charges, the right to a fair and impartial hearing, and the right to be represented by counsel. But Gault did not grant full due process protections to juveniles facing delinquency complaints. Notably absent are a childs right to a grand jury determination of probable cause and the right to an open and speedy trial by jury. And, at least in Ohio, juveniles have yet to fully realize the promises of Gault. A recent study found that two-thirds of children facing unruly or delinquency complaints are not represented by counsel when they appear in Ohios juvenile courts.

The failure to fully protect juveniles constitutional rights is certainly not limited to Ohio. Last month, two Luzerne County, Pennsylvania judges pled guilty to receiving $2.6 million in kickbacks to send juveniles to certain juvenile detention facilities. A lawsuit filed by the Juvenile Law Center on behalf of 70 families affected by this scandal alleges that the two judges violated the rights of juveniles in ways that went beyond the kickback scheme.10 The lawsuit asserts that in a wave of unprecedented lawlessness, the judges failed to advise youth of their right to counsel, accepted their guilty pleas without explaining the charges against them, and garnished the wages of their parents to pay the costs of detention. If Pennsylvania were to adopt the Adam Walsh Acts overly broad offense-based system, some of these youth, forced to enter admissions to sexual offenses in courts that showed complete disregard for their constitutional rights, would automatically be labeled Tier III and subject to lifetime registration and notification.

The Guidelines for implementation, issued by the SMART Office, instruct that registration need not be required on the basis of a foreign conviction if the conviction was not obtained with sufficient safeguards for fundamental fairness and due process The Guidelines fail to acknowledge, however, that only limited due process protections are offered to children in juvenile court. By placing juvenile sex offenders on a public registry, the Adam Walsh Act imposes adult sanctions on juvenile defendants. It treats a select group of children who appear in juvenile court differently than other children who appear in juvenile court; it treats them more like adult sex offenders than like children. And it does so without regard to the limited due process protections offered to children in juvenile court.

Limited due process protections make the retroactive application of the Adam Walsh Act especially inappropriate for juveniles. Children who have already been through the juvenile court systemwithout full due process protections and perhaps without even being represented by counselcould never have anticipated that lifetime inclusion on a public registry would someday be a consequence of their juvenile court proceeding.

Recognizing the unique qualities and needs of children, the juvenile court system was established to focus on treatment, supervision, and control, rather than solely on punishment. Inclusion on a public registry, though, will significantly limit treatment and aftercare options for juvenile sex offenders. Many group homes, foster homes, and community placements will not accept children with sex offenses in their histories. Children on a public registry with community notification requirements will be nearly impossible to place for or after treatment. As a result, many juvenile sex offenders will be kept in juvenile correctional facilities far beyond the time it takes them to complete treatment. Children will be incarcerated not because they need further treatment or pose a risk to public safety, but only because public policy will prevent them from going anywhere else. This is a dramatic, and ill-advised, shift in the focus of the juvenile court system from treatment to punishment.

Subjecting juvenile sex offenders to the same sanctions as adults raises legal and scientific questions about culpability and punishment, and the registration and notification requirements are inconsistent with the purposes of juvenile court: treatment and rehabilitation. Inclusion on an internet-based public registry will subject juveniles to social ostracism, limit access to educational and work opportunities, make it more difficult for juveniles to be placed with family or friends, and limit residential treatment options. And treating juvenile sex offenders in the same manner as adult sex offenders with respect to reporting, notification, and length of classification, even though juveniles have fewer legal rights and protections than adults, presents legal and Constitutional problems.

The plain language of the Adam Walsh Act requires that all children age 14 and older who are adjudicated delinquent for offenses comparable to or more severe than aggravated sexual abuse be included on the public, online registry of sex offenders. But the negative consequences of doing sofewer intra-familial crimes being reported, fewer offenders and victims receiving treatment, and children on the registry being targeted for abuse and exploitation, to name only a fewwould actually put states out of compliance with the stated intent of the Adam Walsh Act: protecting children from violent sex offenders.

To this day, I still check her myspace to see if it's still private. I still look at Eric's facebook and myspace. I still see if Michelle has updated her livejournal. She's married now. I've saved chats, IMs, pictures, and drawings from everyone and they're on a CDin my room. I save the pictures I find onEric's facebook. I wonder if they still think about me or if I'm the only one who reminisces about music0. We had a lot of fun. Jennifer She was my best friend in the chat, even though I didn't start talking to her until I needed someone to share my dramatic life with. She's a good listener and a genuine person. I could tell her anything and we would talk for hours.

Ron is unpredictable and not to be trusted but I wanted any kind of sympathy I could get from anyone who would listen so I confided in him when I had no one else, despite my better judgment. He was a shape shifter, and I could never tell if he was being serious or not so he made me really nervous.

Carrie she was the first one who showed me her pictures in chat and I was her little brother and she was my big sister. After our friendship changed, I liked to amuse myself by annoying her with Eric.
