The pop star will not be required to take the stand in her conservatorships ongoing quest to obtain permanent restraining orders against her former manager Sam Lutfi; attorney Jon Eardley; and her ex-beau Adnan Ghalib.
There was a finding of a judge of the Superior Court that she lacks the capacity to testify, Los Angeles Superior Court Judge Aviva K. Bobb said after hearing closing arguments Tuesday, upholding a 14-month-old ruling that Spears isnt mentally fit to make her own legal decisions.
The temporary restraining orders against all three men were extended until April 28, when the judge will hear rebuttal arguments before making a final decision.
Eardleys attorney, Roger Diamond, filed a motion April 10 to compel Spears to testify before closing arguments were made, but there was no sign of her at the courthouse today.
Its unclear whether the 27-year-old singer, who just played four dates in L.A. and Anaheim, is still in SoCal at the moment. Her Circus tour touches down in Oakland Wednesday night.
In his remarks today, Diamond argued that Spears wanted Eardley—who is said to have collaborated with Lutfi last year to help Spears fight what was then a brand-new conservatorship—to help extricate her from father Jamies control.
Britney Spears is crying out for help, Diamond said.
Lutfi attorney Bryan Freedman, taking a somewhat less-contentious approach, said that there was a lack of evidence as to emotional distress to Britney perpetrated by his client.

On the same day that a poll shows that a majority of Canadian want more stimulus spending, CNN brings us this fascinating story out of Hawaii. A group of business owners, reliant upon tourism dollars, were told by the government that Polihale State Park would have to close, perhaps for as long as two years, because there were not enough funds to repair a bridge washed out by floods. Facing the prospect of having their businesses go under if the park stayed closed any longer, local companies got together and fixed the bridge themselves in only eight days, saving the government four million dollars, and hopefully, their own livelihoods.

But, what I want to know is...how many jobs did this stimulate? Was there any trickle-down effect from the money? Did some magical force multiply each penny spent, so that a box of nails purchased in Kauai paid off a subprime mortgage in Florida.

Nicolas Cage is such a pompous ass. He would like us to all believe that he is hurting financially. I will tell you what hurts Nic. It hurts to watch those plugs of yours do lousy movie after lousy movie while you rake in $10M. That is what hurts. Oh, and making people spend $15 to go see the crap as well.

What brought all of this about is that Nic sold his castle in Bavaria. Two years ago he bought a 28 room castle which sits on a modest 410 acres and set him back about $2.6M. Considering that will maybe get you 3 bedroom fixer upper in Beverly Hills on a very tiny lot, that seems like a pretty good deal to me. Apparently though Nic doesn't agree. He told the German magazine Bunte, "Due to the difficult economic situation, unfortunately, I was no longer able to keep it."

Uh huh. Whatever. I guess we are supposed to feel sorry for him, but I'm not buying it. "Even if Neidstein castle is no longer in my possession, it will always have a firm place in my memory." Yeah, that's why no one has seen you at the place in 18 months. See, he didn't sell it because of the difficult economic times, he sold it because he has too damn many houses all over the world and couldn't find time to use it. I would love to see the studios tell him they can't give him as much money for his next movie due to the tough economic times and see if he agrees with it then.

I went to the Britney Spears concert with a group of friends including my fanatical-fan friends Greg and Shane. Cut to the chase: it was a major disappointment. While the production value was very high -- Cirque du Soleil-type acrobatics, great videos, fire -- she didn't dance very much. And, honestly, Britney, if you're not going to sing, can't you at least dance? With a snake?
Here were my thoughts during the concert:
The Pussy Cat Dolls opened. They sang -- well, lead singer Nicole did. And lots of pole dancing in bikinis.
Intermission meant circus acts, with clowns, midgets, a guy twirling what looked like chain-link fencing, and extreme hula-hooping. Right before Britney's show started, Madonna's "Ray of Light" comes over the speakers, leaving my friends confused.
Britney is lowered from the ceiling with the opening beats of "Circus." The crowd of girls, gays and women, wearing a lot of fedoras, goes wild. Brit marches from one end of the three ring, er, circus to the other, with random hand flips. Her hair looks great. And real. But she seems a little scared.
Ten minutes in and not a lot of movement from Brit. She seems a little out of it. Not much dancing during "Radar." She seems to always be on some moving piece of furniture, or in a cage on wheels. It's almost like they're keeping her in a stroller. Good hair tossing, though.
Clearly her mic isn't even on. This was very obvious when she went into a box so the circus people could saw her in half. No worries -- everyone is singing along with her.
40 minutes into the show, her mic is turned on. "What's up Dallas! Thanks for coming!" Then turned off. She slowed things down with "Everytime," which she "sang" sitting in a huge umbrella suspended in the air, and people started leaving. Coincidentally, the alcohol service was also turned off.
While Britney didn't do a lot of dancing, her 10-plus back up dancers did. Very well. And with lots of suggestion. The seeming job of two guys was to hold her hands as she ran across the floor and climb on top of furniture.
Saddest part: the half-hearted fist pumping dance moves during "Slave 4 U."
Did dance a little bit more during "Toxic" and "Hit Me Baby, One More Time." The accompanying video montage, of all her past videos only highlighted her lack of Britney-when-she-was-with-Justin dancing. She seemed robotic, disconnected.
"I think it was too much, too soon," my friend Greg said on the way out. "Yeah," Shane agrees, looking a little upset. "I am worried about her. She wasn't ready." Regardless of the mega-fan's reaction, the crowd loved it. Perhaps it was the 3-foot margaritas.

The principal had ordered the Chinese device online, but some angry students were quick to find out and inform him that he was breaking the law. So much for that idea. Now, he's left looking pretty bad while cellphone use in school now seems like some kind of civil rights issue to some students.

It seems like this is less about the cellphone ban and more about maintaining authority in the school. On that front... this completely backfired. Plenty of schools have effective cellphone bans without resorting to technological blocks (I attended such a high school). Maybe the principal should explain to students and teachers why cellphones are a problem, set some reasonable guidelines for use and some reasonable consequences for violations of the policy. That would probably go a lot further to establish the principal's authority and gain his students' respect than installing an illegal device and being forced to backtrack ever could.

Some of the biggest singer/songwriters in pop history have visited American Idol over the past few seasons: Mariah Carey, Dolly Parton, Neil Diamond, Tony Bennett, Jon Bon Jovi and even Bono.
But while judge Simon Cowell said during a conference call Wednesday (December 17) that the show has never been able to nail down the one mentor it has tried to get every year to help the kids on the show — ex-Beatle Paul McCartney — he has big hopes for this years slate of mentors. Specifically, he has one name in mind that he would love to see on the marquee: Britney Spears.
She would, literally, be first on the list as far as Im concerned in any capacity, Cowell said. He didnt actually divulge who would appear as mentors/performers for the upcoming season — which kicks off January 13 — but he said the door is open any week for Britney to drop in. I would love to see her mentor the contestants, but if she doesnt want to do that, and she wants to come on the show and perform, I would welcome her anytime.
Part of the reason Cowell is so open to Spears stopping by is that when she appeared on his British talent show recently, The buzz we had on our show when she came on was extraordinary. And even with all the stuff thats gone on with her the past two years, there was more excitement and interest in her than Ive seen in anyone in years. She would be very, very welcome.
McCartney and Spears are at the top of the list, but Cowell said hed also love to have another recent guest make her way to : Beyoncé. We just recently had Beyoncé on the British version of the show. [She] was absolutely incredible. You want those kinds of artists. Id like people with personalities.
He also opened the door for a couple of past judges/mentors hed like to see come back: Lionel Richie and filmmaker Quentin Tarantino.

Anyclown, Xtina invited all sorts of celebs including Nicole Richie, her man and his brother BENJI as in Madden, AND Valtrex bot showed up with some other dude, (poor guy) So. they did not go together. maybe he and Brit are dating.ok. Thats a reach I know  Hes allowed to travel alone For now Ok, Ill stop.

 Anyherps, Dont you think Nicole gets sick and tired of seeing that bitch everywhere she goes? She cant attend one function without Paris being there and when her and Benji are FINALLY over, she still manages to be at the same party. Its really quite desperate looking.  Go hang out with your money, fool.
I think the reason she moved on from Benji was she thought originally, by dating him that her and her old BFF Nicole were gonna hang out and compare Madden brother peen and giggle all day but Nicole was over that shit.

This party also made me sad because it reminded me of just how not normal my dolls life is. Heres Xtina, a girl she practically grew up, enjoying her 28th birthday with friends, her husband, and dirty martinis. Dirty martinis are her best friend ever. They always listen to Xtina when shes down.
Seeing her have this much fun and truly looking happy as hell just reminded me even more that my poor doll is in a conservatorship, doesnt really speak in public, is back to being very shy and insecure, and cant even enjoy her 27th birthday with cocktails and friends and perhaps a hubby. Isnt life strange, how it took two totally different paths for her and Xtina.
Im sure it would be depressing for Brit to know she couldnt attend this party. I mean, her future man was there plus Xtina and all those cocktails. You people really have issues with cocktails. Seek help.
I wonder if Britney knew about this party. How sad, she cant go. I bet you she was dying to go but pepaw probably said I either go with you or no deal. Its just way too risky especially with all those delicious cocktails standing around just staring at me.

Not to brag but... Traci and I were total VIPs last night at an event featuring Britney's most well-known impersonator Derrick Barry. He invited us to his show at Rage in West Hollywood and OF COURSE we jumped at the chance to go! We were dancing and hollering on the balcony, which was the absolute best spot in the house to view the show!

Derrick performed a 'Womanizer-Circus' remix first, then he and celebrity artist Nick San Pedro came up to meet us mid-show. Derrick and Nick were sssoooo sweet... totally new BFF/top friends on MySpace. (LOL)

Traci was camera-lady for the night and did a fab job getting loadsa pics of D. I took some footage too that you can see after the jump. :)

One of the many highlights of the night was when some paparazzi showed up thinking the REAL Britney was at the club. Derrick totally punk'd the paps!

Loving every minute of it.
